Supermicro's Yih-Shyan “Wally” Liaw has resigned from the board of the server maker he cofounded.

Liaw was one of three Supermicro workers who the US government has charged with illegally smuggling Nvidia GPU servers into China. The indictment claims that some $2.5 billion in servers were shipped to China, despite Supermicro lacking a Commerce Department license.

"Mr. Liaw has resigned from the Company's Board of Directors, effective immediately," the company said in a press release.

"Following Mr. Liaw's resignation, the Company's Board comprises eight directors. There are no changes to the Board's committee structure."

Liaw's initial court appearance was held on Thursday in the Northern District of California. His bond hearing is set for next Wednesday.

Supermicro also announced that it had appointed DeAnna Luna as acting Chief Compliance Officer, effective immediately. Luna joined Supermicro in 2024 as the VP of Global Trade & Sanctions Compliance.

Shares in the US-headquartered company are down 33 percent following the indictment.
