Vertical Bridge REIT LLC has filed a lawsuit against EIP Holdings II LLC and Everest Infrastructure Partners Inc.
A lawsuit was filed by K&L Gates law firm last week on behalf of its client Vertical Bridge, alleging that EIP Holdings and Everest implemented a scheme to unlawfully misappropriate trade secret information, according to Law.com.
The suit also alleges that Everest engaged in “false advertising, tortious interference with contract and unfair competition.”
Vertical Bridge claims Everest obtained its trade-secret pricing terms through the properties' landlords, according to a complaint published in Law360.
In its filing, Vertical Bridge said: "Everest… deploys a form of tower aggregation made possible only by unlawful misappropriation of trade secrets in order to tortiously interfere with existing VB contracts."
The company claims Everest has "subverted its first right of refusal in purchasing the land underneath its towers."
The case is set to be heard in the US District Court for the Western District of Pennsylvania.
